These Terms of Service govern your access to and use of the MoatPeak website and services operated by MB "MoatPeak Group", registered in Lithuania.

By accessing our website, creating an account, or purchasing a subscription, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use our paid services.

2. Our service

MoatPeak provides subscription-based access to macro, sector, thematic, and company research for informational and educational use.

We may update, improve, modify, suspend, or discontinue any part of the website or service at any time.

3. No investment advice

MoatPeak provides research and educational content only. Nothing in the service constitutes personal investment advice, regulated financial advice, or a recommendation to buy, sell, or hold any security or financial instrument.

4. Accounts

To access certain features, you may be required to create an account.

You agree to:

• provide accurate and current information;
• keep your login credentials secure and confidential;
• take responsibility for all activity under your account.

We may suspend or terminate your account if it is used unlawfully, fraudulently, abusively, or in breach of these Terms.

5. Payments, subscriptions, and billing

Paid subscriptions are offered according to the pricing displayed at checkout.

Where MoatPeak uses Stripe Managed Payments, Stripe may act as merchant of record for the transaction. This means that payment processing, indirect tax collection, fraud prevention, dispute handling, and certain transaction-related support functions may be handled by Stripe in accordance with Stripe’s terms and policies.

By purchasing a subscription, you authorize the applicable payment provider and merchant of record to charge the total amount shown at checkout.

6. Prices and taxes

Unless stated otherwise, prices shown at checkout are inclusive of applicable taxes.

Where required for your jurisdiction, the total amount charged at checkout may reflect applicable VAT, GST, sales tax, or similar indirect taxes included in the displayed price.

7. Renewals and cancellation

Unless otherwise stated at checkout, subscriptions renew automatically at the end of each billing cycle.

You may cancel automatic renewal at any time through your account settings or by contacting info@moatpeak.com.

Cancellation prevents future renewal charges. It does not retroactively cancel the current paid subscription term unless required by law or expressly stated otherwise.

8. Digital access and consumer rights

MoatPeak provides digital content and digital subscription access.

By completing your purchase, you request that access to the digital service begin as soon as possible after payment is completed.

If you are a consumer, you may have mandatory rights under applicable consumer protection laws. Where permitted by law, once digital access begins, your right to withdraw or receive a refund may be limited.

Nothing in these Terms limits any non-waivable rights you may have under applicable law, including rights relating to digital content or digital services that are faulty, not as described, or otherwise not in conformity with the contract.

9. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

10. Acceptable use

You agree not to:

• copy, reproduce, republish, sell, sublicense, scrape, or commercially exploit MoatPeak content without our written permission;
• share subscriber-only materials beyond what is permitted by law;
• interfere with the security or functioning of the website or service;
• use the service for unlawful, fraudulent, or abusive purposes;
• upload or distribute malware, malicious code, or harmful material;
• impersonate another person or misrepresent your identity or affiliation.

11. Intellectual property

All content, branding, research, text, graphics, and materials available through MoatPeak are owned by or licensed to MB "MoatPeak Group" and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for your personal or internal business use only, subject to these Terms.

12. Availability

We do not guarantee uninterrupted or error-free operation of the website or service. Access may occasionally be unavailable due to maintenance, technical issues, third-party outages, provider downtime, or events beyond our control.

13. Disclaimers

The service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee completeness, accuracy, reliability, availability, or fitness for a particular purpose.

14. Limitation of liability

To the fullest extent permitted by law, MB "MoatPeak Group" will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, goodwill, or investment losses arising out of or related to your use of the service.

To the extent liability cannot be excluded, our total liability arising out of or related to the service will not exceed the amount paid by you to MB "MoatPeak Group" during the 12 months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law.

15. Termination

You may stop using the service at any time.

We may suspend or terminate your access if you breach these Terms, misuse the service, fail to pay, or create legal, operational, or security risk for us or others.

16. Governing law

These Terms are governed by the laws of Lithuania, except where mandatory consumer protection laws in your country of residence apply.

17. Disputes

If you have a complaint, please contact us first at info@moatpeak.com so we can try to resolve it informally.

If a dispute cannot be resolved informally, it will be subject to the competent courts of Lithuania, unless mandatory consumer law provides otherwise.

18. Changes to these Terms

We may update these Terms from time to time. The latest version will always be posted on this page with the updated effective date.
